Terms Of Service

Last updated August 30, 2026. AuctionAxis is the regional auction service for vehicles, work trucks, and equipment, operated from Hamilton, Ontario. These terms govern everyone who registers, bids, or buys through AuctionAxis. Consignors are governed by the Consignment Agreement.

1. Registration and eligibility

You must provide a valid email address and accurate contact information to register. You must be legally able to enter into binding contracts (in Ontario, generally 18 or older). One person, one account. We may refuse, suspend, or cancel any registration or bid at our discretion, including where we reasonably believe bidding is not genuine or a registrant has previously defaulted.

2. Bids are binding

When you bid — including by setting a maximum bid that our proxy bidding system executes on your behalf — you are making a binding offer to buy the lot at that price. You cannot retract a bid. If you are the high bidder when the lot closes, you have bought the lot, subject to the reserve (if any) being met.

3. How our auctions run

Lots close on a posted schedule. Bidding inside the final moments extends the closing time (a "soft close") so all bidders get a fair chance to respond — the exact extension is shown on the lot. The high bid is executed by our proxy system in the smallest listed increment above the competing bid, never more than your maximum. Our decisions on disputed bids, re-opened lots, and refused bids are final.

4. Buyer's premium and payment

The buyer's premium is currently 10% of the hammer price, added to your winning bid and always shown before you bid. Total due = hammer price + 10% buyer's premium + applicable taxes. Payment is due within 3 business days of the auction closing, by the payment methods we identify at checkout. We may require verified payment credentials before accepting bids on high-value lots.

5. Everything sells as is, where is

All lots are sold "as is, where is" with no warranty of any kind, except what the listing and condition report expressly state and whatever rights Ontario law gives buyers that cannot be excluded. We write condition reports honestly and name the flaws — read them, view the lot at inspection times, and ask questions before you bid. Winning an auction is not grounds to renegotiate because you didn't.

6. Title, transfer, and paperwork

For motor vehicles, title passes on full payment in accordance with Ontario law and OMVIC/MVDA requirements; we coordinate the transfer and provide the applicable disclosure package. For equipment and other goods, title passes on full payment and release. We coordinate pickup and transport; pickup is normally completed within 7 calendar days of the auction closing.

7. If you don't pay

A buyer who fails to pay within 3 business days defaults. The lot may be re-offered, and the difference between the original hammer price and the re-offered price, plus our reasonable costs, is owed by the defaulting buyer. Defaulting accounts are suspended. Deposits or card pre-authorizations taken for bidder verification may be applied against amounts you owe.

8. Refunds and cancellation

Auctions are a commitment both ways: completed sales are final and non-refundable except where we cancel a sale (for example, a title or disclosure problem discovered before release), in which case you are refunded in full — see our Refund Policy.

9. Acceptable use

No bid manipulation, shill bidding, colluding with other bidders, misrepresenting your identity or intent to pay, or scraping the site. Accounts used this way are banned and their bids voided.

10. Liability

To the extent permitted by law, AuctionAxis is liable to you only for direct damages up to the amount you actually paid us for the lot concerned, and is not liable for indirect or consequential losses. Nothing in these terms limits liability that cannot be limited by law.

11. Changes and governing law

We may update these terms; the version in force when you placed a bid governs that bid. These terms are governed by the laws of Ontario and the federal laws of Canada applicable there. Questions: contact us through the site before you bid.
